MGM Resorts International experienced two cybersecurity attacks in which third-party intruders may have accessed personal and financial information belonging to its customers, one in or around July 2019 and another on or about September 11, 2023. Several class actions were filed in Canada over these data incidents, including the Dahan and Zuckerman cases in the Superior Court of Quebec and the Thandi case in the Supreme Court of British Columbia.

The parties have reached a proposed national settlement in which MGM will pay CAD $4,000,000 to resolve all of these class actions. MGM denies all allegations and any liability, and no court has found MGM liable. The Superior Court of Quebec scheduled a hearing for May 20, 2026 to decide whether to approve the settlement, and the claims process will open only if the settlement is approved.

Claim types

Substantiated Losses

For class members who can document out-of-pocket losses reasonably attributable to the data incidents.

Payment: $20,000 maximum per approved claim, subject to the settlement fund and pro rata provisions

Who qualifies

  • Submit a timely and valid claim with supporting documentation evidencing out-of-pocket losses reasonably attributable to the data incidents. The email or letter from MGM notifying you of the incident does not count as supporting documentation.

Future Credit Monitoring Expenses

For class members who pay for identity theft protection or credit monitoring after filing their claim.

Payment: Reimbursement of the cost of identity theft protection and/or credit monitoring for a period of up to twelve months following the claim submission date

Unsubstantiated Losses

For class members who file a claim without supporting documents. Amounts depend on whether you were affected by one or both data incidents and may be adjusted pro rata.

Payment: $150 if affected by only one data incident (increasable to a maximum of $500) or $300 if affected by both (increasable to a maximum of $1,000)

What stage is this settlement at?

How much can I receive?

If the settlement is approved, you may claim documented out-of-pocket losses to a maximum of $20,000 per approved claim, reimbursement of one year of future credit monitoring expenses, and a payment for unsubstantiated losses of $150 (increasable to a maximum of $500) if you were affected by one incident or $300 (increasable to a maximum of $1,000) if affected by both the 2019 and the 2023 incidents. Amounts may be reduced pro rata depending on the number and value of approved claims.

How do I file a claim?

There is no claim process yet. If the settlement is approved, you will need to submit a Settlement Claim Form by a claims deadline. Instructions and deadlines will be posted at https://www.MGMDataSettlement.ca.

What do I need to do now?

You do not need to pay or do anything at this stage to remain included. If you did not want to be bound by the settlement, the deadline to opt out was May 17, 2026, and it has passed. The deadline to object or comment was May 13, 2026, and it has also passed.

What happens if I do nothing?

If you do nothing and the settlement is approved, you will remain in the class and be bound by the judgment and release, and you may submit a claim by the claims deadline to receive benefits.
