In August 2021, Kent Pharmacy in New Westminster, British Columbia gave COVID-19 vaccinations to 96 people over three days. The Fraser Health Authority later wrote to those people to tell them that the syringe barrel used for the injections had been re-used between patients. Because of this, they were told they were at risk of contracting hepatitis B, hepatitis C and HIV, and were advised to take three blood tests over the following three months.
A class action was brought on behalf of the affected patients, and a settlement has been reached. The settlement creates two funds: Fund 1 of $307,200 pays each approved class member a payment of $3,200 maximum without any proof of injury, and Fund 2 of $200,000 pays a further payment of $5,000 maximum to class members who can show they received psychological or psychiatric treatment for more than four months because of the incident.

How much can I receive?
Every approved class member can receive a payment of $3,200 maximum from Fund 1 without proving any injury. If you can show you received treatment for psychological harm lasting more than four months from a British Columbia licensed psychologist or psychiatrist, you can receive a further payment of $5,000 maximum from Fund 2.
What is the deadline to file a claim?
Your completed and signed Claim Form, with any required supporting documents, must be received by the Claims Administrator on or before September 30, 2026 at 5:00 p.m. Pacific Time. A late Claim Form is treated the same as not filing at all, and you will not be paid.
What proof do I need to provide?
Everyone must enclose a copy of a valid, government-issued photo ID. For the additional Fund 2 payment, you must also attach a solemn declaration and medical documentation from your treating British Columbia licensed psychologist or psychiatrist showing your psychological harm and treatment lasted more than four months.
When will I be paid?
After the claims period ends, the Claims Administrator will review claims and send a successful claims report to the lawyers for the parties. Compensation cheques will be mailed within approximately 60 days after that report is sent, and an announcement will be posted on Class Counsel's website at https://www.dusevicgarchalaw.ca when cheques have been mailed.
Can I file on behalf of someone else?
Yes. If the class member is deceased, a minor, or unable to file for another reason, you can file as their representative, but you must attach a copy of the Certificate of Appointment of Estate Trustee, Power of Attorney or another document establishing your authority to act on their behalf.
