Tyson Larence sued Honk Mobile Inc., which runs an app and website that let people pay for parking online. The lawsuit alleged that Honk displayed its service fee in a way that broke sections 52(1.3) and 54 of the Competition Act and misled customers, and that Honk was unjustly enriched by collecting the fee. Honk denies any wrongdoing and does not admit liability.

The parties reached a proposed settlement in which Honk would give each class member a one-time $0.35 promotional credit to use on its platform, for a total of $347,340 in credits. The proposed settlement still needs court approval. The Supreme Court of British Columbia certified the case for settlement purposes, and a hearing will be held to decide whether to approve the settlement. If approved, class members do not need to file a claim; eligible members will automatically receive a credit code by email.

What stage is this settlement at?

The proposed settlement has been reached and the case has been certified for settlement purposes. It still needs to be approved by the Supreme Court of British Columbia at an upcoming approval hearing before any credits are distributed.

Do I need to file a claim?

No. There is no claim form. If the settlement is approved and you did not opt out, you will automatically receive an email with an individualized promotional code for a $0.35 credit.

How much will I receive?

Each eligible class member receives a single, one-time, non-transferable $0.35 credit to use at checkout on the Honk platform. The credit is not convertible to cash and expires on December 31, 2027.

What do I need to do right now?

Nothing. If you used the Honk platform in Canada and paid a Service Fee between June 23, 2022 and July 24, 2024, you are automatically included in the class. You do not need to register, file a claim form, or contact anyone. If the court approves the settlement, Honk will email you a promotional code for a $0.35 credit at the email address linked to your Honk account. The credit arrives automatically. There is no claims process.

When will I get my credit?

After the settlement is approved and becomes final (the Effective Date), Honk will email each class member who did not opt out an individualized promotional code. The credit must be used before it expires on December 31, 2027.
