About this claim

If you were prescribed and took REXULTI between February 16, 2017 and August 23, 2025 and then developed a compulsive behaviour such as gambling, hypersexuality, binge eating, or compulsive shopping, or you are a family member of someone who did, you may be eligible for a cash payment.

REXULTI (generic name brexpiprazole) is a prescription medicine sold in Canada by Otsuka Canada Pharmaceuticals Inc. and Lundbeck Canada Inc. to treat certain mental health conditions. The class action alleges that the companies were negligent in failing to warn patients that REXULTI can cause, contribute to, or worsen compulsive behaviours and impulse control disorders, specifically compulsive gambling, hypersexuality, binge eating, and compulsive shopping.

On December 3, 2021 the Superior Court of Quebec authorized a national class action against the defendants, who deny the allegations. The parties reached a settlement that created a CDN $4.75 million fund, with about CDN $2.85 million available to pay compensation for approved claims. The settlement pays money to class members who developed these behaviours and to their eligible family members.

Frequently Asked Questions

How much money can I receive?

Compensation depends on your claim. Psychological harm is paid at one of four levels (mild, moderate, severe, or residual catastrophic injury). A separate fund of CDN $570,000 covers financial losses and is shared pro rata. Eligible family members receive a fixed percentage of the class member's psychological harm payment (spouses 10%, parents and children 5% each, and grandparents, brothers and sisters 2.5% each).

What is the deadline to file a claim?

Completed Claim Packages must be received or postmarked no later than August 27, 2026. The original deadline of July 27, 2026, was extended to allow more class members an opportunity to submit a claim.

What proof is needed to file?

Claimants must attach prescription records and/or medical records showing they were prescribed and took REXULTI, along with the documents required for their claim type (for example medical records for treatment, or gambling and financial records for financial loss), and sign attestations confirming their experience.

How are claims filed?

Claimants complete and sign the Claim Form and mail or email the completed Claim Package with supporting documents to the Claims Administrator, MNP Ltd., in Calgary. The form can also be requested from the settlement website, or Class Counsel - Rochon Genova LLP.

What if I can not obtain my prescription or medical records?

The Claim Form includes a physician declaration and a missing documentation declaration. In extraordinary circumstances, a claimant who can not obtain the required records can provide a signed physician declaration and their own declaration explaining their reasonable best efforts to obtain them.
